1. Agreement to these terms

These Terms and Conditions ("Terms") are a binding agreement between you and Conifer Advising LLC ("we," "us" or "our"). They govern your purchase and use of our mass timber data products, which include:

  • Custom Reports: one-time, single-purchase reports generated from filters you select (Section 4).

  • Annual Subscription: paid, time-limited access to our live Mass Timber Map dashboard (Section 5).

By checking the box at checkout, completing a purchase, or accessing any Product, you agree to these Terms. If you are purchasing for a company or other organization, you confirm that you have authority to bind it, and "you" includes that organization. If you do not agree, do not purchase or use the Products.

The free public map on our website is provided for general information only and is also subject to Sections 3, 8, 9 and 10.

2. Definitions

  • "Data" means the project, manufacturer, installer, location and related information we compile and make available through the Products.

  • "Products" means Custom Reports, the Annual Subscription, and any related websites, dashboards, downloads and emails.

  • "Report" means a Custom Report file (PDF, Word or other format) generated for you from the filters you selected at purchase.

  • "Generation Date" means the date and time a Report was created, as printed on the Report.

  • "Subscription Term" means the 12-month period of access you purchase under the Annual Subscription, and each renewal period.

  • "Authorized User" means the individual named on a Subscription account, plus any additional users you have paid for.

3. Nature of the Data

The Data is a point-in-time snapshot, compiled from public sources, industry contacts and our own research. You acknowledge that:

  1. It reflects only what we had on the Generation Date (for Reports) or at the moment you view it (for the Subscription). Projects are added, removed, renamed and corrected continuously, and the Data may change at any time without notice.

  2. It may be incomplete or inaccurate. We do not claim to list every mass timber project, manufacturer or installer. Details such as names, years, statuses and addresses may contain errors or be out of date.

  3. Map locations are approximate. Project locations are generated automatically from addresses and may not match the actual site.

  4. We have no obligation to update a Report. A Report will not change after its Generation Date, even if the underlying Data is later corrected.

  5. It is not professional advice. The Data is not engineering, architectural, legal, financial, investment or procurement advice. You are solely responsible for independently verifying any Data before relying on it and for all decisions you make using it.

4. Custom Reports

  1. One Report per payment. Each purchase entitles you to one Report generated from the exact filters shown on the order summary at checkout. Filters cannot be changed after payment. A different filter set requires a new purchase.

  2. Previews. Project counts and other summary information shown before purchase are estimates. The final Report may differ slightly if the Data changes between preview and generation.

  3. Generation Date. Every Report shows its Generation Date and a unique Report ID. The Report reflects the Data as of that date only.

  4. Delivery. Reports are delivered as a download link on the confirmation page and by email to the address you provide at checkout. Delivery is complete when the Report is generated and made available to you.

  5. Re-downloading. You may re-download the same Report through your emailed link or our "Find My Reports" page for at least 12 months after purchase. Re-downloading provides the original Report unchanged, not an updated version. You are responsible for saving your own copy; we may retire older Reports after that period.

  6. Keep links private. Download and sign-in links are personal to you. Anyone with your link can access your Report, so do not forward them. We are not responsible for access by people you share links with.

  7. Delivery problems. If you have any trouble generating, downloading or opening a Report, contact us at support@coniferadvising.com. We will work with you to troubleshoot and resolve the issue.

5. Annual Subscription

  1. Term. The Subscription gives Authorized Users access to the live Mass Timber Project Database for 12 months from the purchase date.

  2. Automatic renewal. Unless you cancel, your Subscription renews automatically for another 12 months at the then-current price, and we will charge the card on file on the renewal date. We will email you a reminder between 15 and 45 days before each renewal with the renewal date, price and how to cancel.

  3. Cancelling. You may cancel at any time by logging in to your customer account on our website, clicking Account, then Subscriptions (or Digital products), and selecting Cancel subscription. You can also email support@coniferadvising.com. Cancellation stops the next renewal. Cancellation stops the next renewal. You keep access until the end of the current Subscription Term. No partial refunds are given for unused time (Section 7).

  4. Price changes. We may change the Subscription price for future renewals. We will notify you at least 30 days before a renewal at a new price, and you may cancel before it takes effect.

  5. Live data. Dashboard Data is updated on an ongoing basis and may change at any time. Section 3 applies to everything shown in the dashboard. Screenshots, exports or notes you take reflect the Data only at that moment.

  6. Features. We may add, change or remove dashboard features, filters or data fields. We will not materially reduce the core project data available during your current Subscription Term.

  7. Authorized Users. Each Subscription is for one named individual. Login credentials and access links may not be shared with anyone else. We may suspend access if we detect sharing.

  8. Availability. We aim to keep the dashboard available but do not guarantee uninterrupted access. Maintenance, third-party outages (including Google, mapping and payment providers) and other interruptions do not entitle you to a refund or extension.

6. Payment

  1. Prices. Current prices for Custom Reports and the Annual Subscription are listed on our website in US dollars. The price that applies to your purchase is the one shown on the order summary when you pay. We may change prices at any time; changes do not affect purchases already made, and Subscription price changes follow Section 5.4.

  2. Payment method. We accept major credit and debit cards. Payments are processed by Stripe, Inc. We do not receive or store your full card number.

  3. Taxes. Prices exclude applicable sales, use or similar taxes, which will be added at checkout where required. You are responsible for any taxes other than those based on our income.

  4. Authorization. You confirm you are authorized to use the payment method you provide. For Subscriptions, you authorize us to charge it on each renewal date until you cancel.

  5. Failed payments. If a renewal payment fails, we may suspend Subscription access until payment is received.

  6. Chargebacks. If you dispute a valid charge with your card issuer instead of contacting us, we may suspend your access to all Products and Reports while the dispute is open. We will provide the issuer with records of your purchase, acceptance of these Terms and Report delivery.

7. All sales are final — no refunds

Because Reports and Subscription access are digital content delivered immediately after purchase, all sales are final and non-refundable. This includes:

  • Reports you did not find useful, that contained fewer projects than expected, or whose Data later changed.

  • Reports purchased with the wrong filters. Please review the order summary carefully before paying.

  • Unused time remaining in a Subscription Term after you cancel, and renewals you did not cancel before the renewal date.

By completing your purchase, you agree that delivery begins immediately and you waive any right to cancel or withdraw after delivery, to the extent permitted by law.

The only exceptions are (a) a technical failure on our side that we cannot fix under Section 4.7, in which case we will refund that purchase, and (b) any refund required by applicable law.

8. License and permitted use

Ownership. We own the Data as compiled, the Reports' format and design, the dashboard and all related intellectual property. You receive a license, not ownership.

Your license. Subject to these Terms and payment, we grant you a non-exclusive, non-transferable license to use Reports and dashboard Data for your own internal business purposes. For Reports this license is perpetual. For the Subscription it lasts for the Subscription Term.

You may:

  • Share a Report within your own organization.

  • Quote or summarize limited portions of the Data in your own work product, such as proposals, presentations or articles, with attribution to "Conifer Advising’s Mass Timber Data, [Generation Date]".

You may not:

  • Resell, sublicense, publish or distribute a Report or substantial portions of the Data to anyone outside your organization.

  • Use the Data to build or supplement a competing database, map, directory or data product.

  • Scrape, bulk-download or systematically extract Data from the dashboard, or attempt to bypass paywalls, limits or security measures.

  • Use the Data to train or fine-tune machine-learning or AI models.

  • Share Subscription credentials or Report links with anyone not entitled to them.

  • Remove the Generation Date, Report ID, copyright or attribution notices from a Report.

We may suspend or end your access if you breach this Section, without refund.

9. Disclaimers and limitation of liability

9.1 No warranties. THE PRODUCTS AND DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE DATA IS ERROR-FREE OR THAT THE PRODUCTS WILL BE UNINTERRUPTED OR SECURE.

9.2 No liability for use of the Data. You use the Data at your own risk. We are not responsible for any decision, action, bid, investment, design, business plan or other outcome based on the Data, or for any errors, omissions or changes in it.

9.3 Excluded damages. TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS OPPORTUNITIES, GOODWILL OR DATA, EVEN IF WE WERE ADVISED OF THE POSSIBILITY.

9.4 Liability cap. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE PRODUCTS OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

9.5 Indemnification. You will defend, indemnify and hold harmless us and our owners, employees and contractors from any third-party claims, losses and costs (including reasonable attorneys' fees) arising from your use of the Data, your breach of these Terms, or your sharing of Reports or access in violation of Section 8.

9.6 Where the law differs. Some jurisdictions do not allow certain disclaimers or limits. In those places, they apply only to the extent permitted.

10. General terms

10.1 Privacy. We collect your name, email, company, billing address and purchase details to deliver Products, send receipts and renewal notices, and provide "Find My Reports." Card details are handled by Stripe. We also keep a record of the filters you chose and your acceptance of these Terms. See our Privacy Policy at https://www.coniferadvising.com/privacy-policy.

10.2 Suspension and termination. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Products unlawfully. Sections 3, 7, 8 (ownership and restrictions), 9 and 10 survive termination.

10.3 Changes to these Terms. We may update these Terms by posting a new version with a new effective date. Changes apply to purchases made after that date. For Subscriptions, changes apply from your next renewal, and we will email you about material changes before then. Each purchase is governed by the version you accepted at checkout.

10.4 Governing law and disputes. These Terms are governed by the laws of New York and the Federal Arbitration Act, without regard to conflict-of-law rules. Any dispute, claim or controversy arising out of or relating to these Terms or the Products will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules or, if you are an individual buying for personal use, its Consumer Arbitration Rules. The arbitration will take place in Kings County, New York or by video conference before a single arbitrator, and judgment on the award may be entered in any court with jurisdiction. Claims may be brought only on an individual basis: you and we each waive any right to a jury trial and to take part in a class, collective or representative action. Either party may instead bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect its intellectual property or stop misuse of the Data. If the class-action waiver is found unenforceable for a dispute, this arbitration clause will not apply to that dispute, which will be resolved in the state or federal courts located in Kings County, New York.

10.5 Entire agreement. These Terms and the order summary shown at checkout are the entire agreement between us about the Products. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent.
